“Amendment to the Turkish Citizenship Regulation”

Article 12, paragraph one, subparagraph (b) of the Turkish Citizenship Law No. 5901 titled “Exceptions for acquisition of Turkish citizenship” stipulates that foreigners who obtain a residence permit pursuant to subparagraph (j) of the first paragraph of Article 31 of the Law on Foreigners and International Protection No. 6458 dated 4.4.2013 and dated 4.4.2013, foreigners who hold Turquoise Cards and their foreign spouses, themselves and their minor or dependent foreign children may acquire Turkish citizenship by a Presidential decree, provided that there is no obstacle in terms of national security and public order.

In Article 20/1-b of the Regulation on the Implementation of the Turkish Citizenship Law published in the Official Gazette dated 06.04.2010 and numbered 27544, it is stated that a person who has purchased immovable property amounting to at least 250,000 US Dollars or equivalent in foreign currency with the condition that an annotation not to be sold for three years is placed in the land registry records, or a condominium or condominium easement has been established, a notarized contract has been signed with the condition that at least 250. 000 US Dollars or its equivalent in foreign currency in advance and promised the sale of the immovable with a notarized contract with the condition of annotating the commitment that it will not be transferred and abandoned for three years in the land registry deed registry, foreigners who are determined by the Ministry of Environment, Urbanization and Climate Change may acquire Turkish citizenship within this scope.

The amount of “USD 250.000” mentioned in the aforementioned article has been amended as “USD 400.000” with the Regulation Amending the Regulation on the Implementation of the Turkish Citizenship Law published in the Official Gazette dated 13.05.2022 and numbered 31834. This amendment will enter into force 1 month after its publication.

On the other hand, with the aforementioned regulation, it has been added to the text of the article that foreigners who are determined by the Insurance and Private Pension Regulation and Supervision Agency to have invested at least USD 500,000 or its equivalent in foreign currency in the private pension system, provided that they keep their contributions in funds whose scope is determined by the Insurance and Private Pension Regulation and Supervision Agency and stay in the system for three years, may also acquire Turkish citizenship. This amendment entered into force on the date of publication of the regulation.
